Bath police charged a woman with driving under the influence Tuesday after she was allegedly driving dangerously on Route 1 and Front Street with two fouryear old children in the vehicle.

Stopped on Front Street at 4:40 p.m. and arrested was Amy Small, 39, of Bath. She was charged with operating under the influence, a Class D crime she has a prior conviction for. She was also charged with assault on law enforcement officer (Class C); two counts of endangering the welfare of a child (Class D); assault (Class D); refusing to submit to arrest (Class D); refusing to stop for law enforcement officer (Class E); operating after suspension (Class E); and violation of license restrictions

According to a press release issued Wednesday, Bath police received a report, relayed through Sag adahoc County 911 Center, from a motorist who was observing a vehicle being operated in a dangerous manner on Route 1 heading Southbound. The caller reported the vehicle was dangerously passing cars and swerving all over the roadway, before taking the Bath exit onto Front Street.

Bath Officer Garrett Olson was in the area and spotted the beige Toyota Corolla as it approached the exit, and then saw the vehicle pass stopped vehicles waiting at the stop sign on Front Street. The Corolla continued to travel down Front Street at a high rate of speed, passing cars on Front Street, police say.

Olson attempted to stop the car and activated his blue lights and siren, but it continued down Front Street, passing more vehicles near Water Street. It accelerated towards Linden Street and eventually stopped abruptly on Front Street just beyond Linden St., striking the curbing.

Police identified Small as the driver, and found two four-year-old children in the car — Small’s daughter and a boy not related to Small.

“During the traffic stop, it was determined that Small was under the influence of alcohol,” the release states. “When Officer Olson went to arrest her, she resisted, attempted to pull away and actively resisted attempts to take her into custody.”

With the assistance of Sagadahoc County Deputies, Small was taken into custody, secured in handcuffs and placed in a cruiser. While in handcuffs during the transport to the police station and throughout the booking process, she reportedly kicked and bit the officers.

Small was transported to Two Bridges Regional Jail in Wiscasset after failing to post bail in the amount of $5,000. She was given a court date of Jan. 13, 2015.

Sagadahoc County deputies Matt Shiers and Mark Anderson assisted Bath Police Department in this incident.

“This was an extremely dangerous situation that could have ended tragically,” said Bath Police Lt. Robert Savary. “We are very fortunate that a motorist called to report the dangerous driving of Amy Small. Furthermore, we are fortunate that Officer Olson located her quickly and was able to stop her before she seriously injured a pedestrian, another motorist, the children in the vehicle or herself.”

Injuries sustained by Olson required medical attention, but are not considered serious.
